General Terms and Conditions Planka Kitchenware
- Definitions In these general terms and conditions the following definitions apply Planka Kitchenware, trade name of Planka Kitchenware, established in the Netherlands Consumer, any natural person acting for purposes outside his or her trade, business or professional activity Agreement, any agreement between Planka Kitchenware and the Consumer regarding the purchase of products Products, all kitchenware products offered by Planka Kitchenware, including but not limited to cutting boards
- Applicability These general terms and conditions apply to all offers, orders and agreements between Planka Kitchenware and the Consumer By placing an order the Consumer agrees to these general terms and conditions Deviations are only valid if confirmed in writing by Planka Kitchenware
- Offer and agreement All offers are non-binding and subject to availability Planka Kitchenware reserves the right to change prices, product information and availability The agreement is concluded at the moment the Consumer receives an order confirmation Obvious errors or mistakes do not bind Planka Kitchenware
- Prices and payment All prices include VAT and exclude any shipping costs unless stated otherwise Payment must be made via the offered payment methods Planka Kitchenware reserves the right to refuse orders in case of payment issues or suspicion of fraud
- Delivery Planka Kitchenware aims to deliver within the indicated timeframe, however delivery times are indicative Exceeding a delivery time does not entitle the Consumer to compensation or termination of the agreement The risk of damage or loss transfers to the Consumer at the moment of delivery
- Right of withdrawal The Consumer has the right to withdraw from the agreement within 14 days after receipt without giving any reason During the withdrawal period the Consumer must handle the product with care The product must be returned unused and if possible in the original packaging Return shipping costs are borne by the Consumer unless stated otherwise
- Use and maintenance of products The products of Planka Kitchenware are intended for normal household use The Consumer is responsible for proper use and maintenance according to the provided instructions Planka Kitchenware is not liable for damage resulting from improper use, negligent maintenance or use contrary to the intended purpose
- Liability Planka Kitchenware is not liable for indirect damage, consequential damage or personal injury resulting from the use of the products Use of the products is entirely at the Consumer’s own risk Planka Kitchenware is not liable for health complaints, illnesses or damage that may be related to exposure to microplastics, material wear or normal use of the products Planka Kitchenware is not liable for cuts, injuries or other physical damage occurring during or after use of the products The liability of Planka Kitchenware is in all cases limited to the amount of the relevant order
- Product information and safety Planka Kitchenware takes care to provide accurate product information and material descriptions Colors, textures and shapes may differ from images The Consumer remains at all times responsible for determining whether a product is suitable for the intended use
- Warranty and complaints Planka Kitchenware guarantees the quality of its products in accordance with statutory provisions Complaints must be submitted in writing within a reasonable period after discovery If a complaint is found to be justified Planka Kitchenware will, at its discretion, replace the product or refund the purchase amount
- Force majeure Planka Kitchenware is not obliged to fulfill its obligations if prevented from doing so due to force majeure Force majeure means any circumstance beyond the control of Planka Kitchenware, including supplier delays, transportation problems and government measures
- Intellectual property All designs, texts, images and product forms are the property of Planka Kitchenware It is not permitted to use or reproduce these without written consent
- Privacy Personal data is processed in accordance with the privacy policy of Planka Kitchenware
- Governing law and disputes All agreements are governed by Dutch law Disputes shall be submitted to the competent court in the Netherlands
- Additional provisions If any provision proves to be invalid, the remaining provisions remain fully in force Planka Kitchenware reserves the right to amend these general terms and conditions The most recent version shall always apply
